Not without requalifying in some manner, and only then assuming no legal bar was placed against you that would prevent you from receiving a visa.

I would say yes, depending on how your case was closed. If proceedings were terminated then you should be fine. But the hard part will be actually getting the visa from the US Consulate.

Hopefully you did not overstay, commit a crime of moral turpitude or such, as that will make it very hard for the consulate to issue a new visa.
