Whether or not you have a Florida concealed weapons permit, you ARE ALLOWED to keep a loaded weapon in your car.

However, there is a rule that specifies HOW it must be kept, and the language of the law states that the weapon must be "securely encased." This means that the weapon must be enclosed, either in a closable case, a closable center console, a closable glove compartment, or the trunk. None of these need to be locked, or lockable. It is generally accepted that a weapon inside a retention-type holster (with a flap, or a strap, or a mechanical retention device) is "securely encased," but I am unaware of any case law specifically addressing this mode of storage.

Of course, having a concealed weapons permit, you do not need to have the gun securely encased. It may be on or about your person--but it must be CONCEALED.

Keep in mind that Florida also has a law which prohibits leaving a firearm accessible to a minor. This means that if you have a minor child who drives the car, or who may simply have access to the car when you're not around, leaving the gun inside may be illegal.

With a concealed weapons permit, you keep your firearm loaded. What good is an empty firearm? However, I never tell people to leave a loaded, or unloaded firearm un attended in a vehicle. It is too easy to break in. If you must leave a firearm in the car, purchase a small locking box type safe and bolt it to the floorboard somewhere out of easy sight for someone looking into your vehicle. These can be purchased from lots of places on line as well.

I got my first CCW in Florida when they first passed the law. That was back around 1988 or 89. Unless they have changed the law...NO. You carry what you like. I have lived in NC since 94 and got a CCW for here as soon as they passed the law. They don't make any distinction either. You can carry whatever you wish. Just a thought...you will probably get tired of lugging around a big @ss .45 revolver real fast. Between trying to keep it concealed without looking like you are trying to hide a bicycle under your shirt and having 3 lbs pulling your pants down, you will be looking for something smaller and lighter in short order. For that matter something the size of the 21 would not make my Top 10 list for concealed carry either.

Just curious...how did you get a concealed weapons permit if you dont know the answer to that question? In my state, you must pass a "competency and proficiency" course that shows that you know how to use your firearm and what you can and can not do. Does Florida just hand them out or do you have to "pass" a class?

YES...You can have it loaded and in your car.However for liability if nothing else it should not be left loaded or unloaded in your car unless YOU are in the car with it. Florida has a few pending major lawsuits in regards to people leaving firearms in vehicles, and the firearms being stolen and used in criminal
acts. Bad Idea to leave your gun unattended at ANY time in your vehicle...Loaded or unloaded.....

Yes, but the weapon must be under your control at all times. If some one gets a hold of it and an accident occurs, it is your fault.

yea you can keep it in your car loaded or unloaded but someplaces say you cant have a loaded gun in there prking lot even if you have a concealed wepons permit

With a CWP you can keep your sidearm loaded in your car.
