we bought a car with my boyfriend its under my name but he drives it.we broke up and i started getting tollway mail for fines that the car had been cought on camera for not paying the Toll payment.All they know is that the car is mine and i am to pay $300 my ex has refused to pay!can i take him to a small court and use the fact that he was paying the monthly payment and not me as proof that he was using the car at the moment and a text message???

Probably not. If the car is in your name, you are responsible for anything and everything that happens to it. If you don't pay the fines, they can in some states revoke both the registration on your car, and your license to drive.

All is not lost though. Go get your car. The police will assist you in doing that if he isn't cooperative with you, since it is your car and in your name. Then tell him he can only get it back by doing two things, paying you back the $300 in tolls he put on it and taking it out of your name. If he won't, sell the car and keep any profit you make over the $300 for your trouble.

You will probably be stuck paying the bill. However, if the car is in your name, you have an option. Give the ex 2 days to repay you, tell him if he doesn't at least make a cash effort, you are cancelling the plates. If they are in your name, he can't renew them, so he can't drive. Tell him if that doesn't work, you are reporting the car as stolen 2 days after that. Once he comes to his senses, and pays you, do anything and everything to get your name off title, registrations, and insurance, unless he is going to give the car back to you.

Now you understand the reason why it is necessary to get your name off the registration and the title. You are responsible for any damage that car may cause.

Hopefully, you can get off the charges, but I would get a lawyer to help with the legalize.

Good luck, and get the car out of your name and the loan if it is in your name. You are leaving yourself wide open for a bunch of lawsuits if you don't.

listen to oklatom - his advice is dead on.

Get that car ASAP, and don't give it back unless he forks over every penny he's put up, and don't let him drive it until he has his own plates (take yours from the car and turn them in)
