He won't pull five years. He'll be sentenced to a year or two. He'll actually do less then that on active time. Probably three to six months. He will probably wind up at a State Farm instead of actually going to Parchman Prison. That's a rough guess because a judge can do pretty much whatever he/she wants in their courtroom. I use to work in Okktibeha County.
He needs to look into AA or something. Sounds like he has a drinking problem.
Remember, it gets really hot in the Delta.

DUI is worse than drug charges because a drunk driver can kill others, a guy that gets caught with drugs is just gonna kill himself. That being said, your BF will probably get no more than 3 years and I would guess more like 1-1.5 years. A lawyer will help and if he can, going to rehab will also look good. AA meetings will help and look good also. He obviously needs these things anyway. Also, most people don't serve their whole sentence, usually they do half to 3/4.

Usually the judge will give the 5 years but with very good behavior the person will do 2 1/2 . why would they give him 5yrs. this is his 3rd DUI He had 2 other warnings and they see it as flagrant disobedience of the law. and also he could have gotten in an acciedent and hurt or killed someone or family.I hope you find this of some help.

DUI is not as bad as "drug charges"?? My oldest sister was killed by a drunk driver. He had also been convicted more than once and had NO business driving a vehicle, let alone being drunk behind the wheel.
You don't honestly expect me (or anyone) to believe that "drug charges" are more of a crime than me losing my sister, do you? And EVERYTIME someone gets behind the wheel and has been drinking, there is the potential for death & tragedy, so you and your boyfriend should be glad he didn't kill anyone.

HE HAS OBVIOUSLY NOT LEARNED HE HAS A DRINKING PROBLEM. MOST DRINKER DO NOT HAVE A PROBLEM. JUST ASK THEM. THEY WILL TELL YOU. I KNOW I AM AA CERTIFIED AS AN ALCOHOLIC, I HAVE BEEN RECOVERED FOR 28 YEARS. (32 YEARS OLD BEFORE I ADMITTED I HAD A PROBLEM)
IN PRISON HE WILL BE ABLE TO HOPEFULLY STAY SOBER. DRY OUT AND TAKE CLASSES TO BETTER HIS LIFE UPON RELEASE(REHABILITATION).
IN MANY STATES (ALABAMA FOR ME) THE JUDGE WILL MAKE STIPULATIONS TO THE 5 YEARS. (MAYBE?? / COMPLETION OF ALCOHOLIC ANONYMOUS PROGRAM AND 6 MO GOOD BEHAVIOR, NO INSTITUTIONAL WRITE UPS, WHILE IN PRISON, BE BROUGHT BEFORE THIS COURT AND BE RELEASED?) CREDIT FOR TIME SERVED WITHOUT WRITE UPS IN ALABAMA 3 FOR 1.(3 DAYS FOR EVERY GOOD ONE SERVED. 5 YEARS MAX = 1826 DIV BY 3 = 608 DIV BY 365 = 1.7 YEARS)
THERE IS ALWAYS A LIGHT AT THE END OF THE TUNNEL. BE SUPPORTIVE OF HIM AND HOPEFULLY HE WILL LEARN AND BE REHABILITATED. HAVE WORKED CORRECTIONS FOR 19 YEARS IN ALABAMA AND HAVE SEEN MANY HAVE TOO TAKE THIS ROUTE TO LEARN A HARD LESSON. AS TANYA TUCKER SAID "STAND BY YOUR MAN" GOOD LUCK.
