Can I have the repair shop or the insurance company fix these problems

First is that they did not replace a fender that is bent 1/4 inch outward, they repainted it but it is still bent out.

Second is that they were suppose to repair and re-surface the hood. They obviously did not sand the hood as they pointed over pine sap and several chips, there are even some small "pits" that are not covered in paint with bare metal exposed.

The same repair shop also installed a broken headlight with JB weld

Are these reasonable complaints, should they fix them?

They didnt make me use their body shop, however they told me that if I did not use their shop then they would cut a check and if there were any extra costs they would not cover it.

Since the shop was part of an insurance company network - that usually means that the insurance company will guarantee the repairs.

Call the body shop that did the work. Take the car back and go over your concerns with the body shop manager. Also call the adjuster and let them know as well. Insurance companies with repair networks usually have appraisers that oversee the repair network. The appraiser may need/want to inspect the substandard repairs the shop did. If this is a habit of the shop, then the insurance company may remove them from the network.

That is totally unacceptable. Since the insurance suggested this shop as one in their network (they can't MAKE you go anywhere you don't want to), this means they stand behind whatever the shop does.

What I would do is this, go to a shop you like, and find out what it will cost to fix their mess up. Then contact the insurance and tell them of your problems and concerns, and let them know if they will pay you the cost of fixing it at a reputable shop, you will go away. Don't threaten, don't yell, but stay on them. Mention, without it sounding like a threat, that you will contact the bureau of what ever agency oversees insurance companies where you are (research that out on line). Be persistent until you are made whole.

Worse case, they will ignore you and refuse, if so, follow though. File a complaint.

Hmmmm...

all of that sounds like bull-arkey to me.

Having handled claims for over a decade......1/2 of what you said is WAY off base

1 - insurance companies are not in the repair business. They can not TELL you where to go.

2 - if they recommend one of their network shops - they are essentially providing a guarantee for your repairs - which means if something is wrong - they guarantee that they will make it right (Which is why it behooves you to use one of their network shops)

3 - if they are paying to repair your damages...they CAN NOT refuse to pay if you do not use one of their shops. Period. The only time they can 'refuse' to pay is if you are the 'claimant' and they have exhausted their limit of liability or if your claim is not covered.

4 - that shop is a joke. If the insurance company paid to repair the fender and all they did was paint it (like no one would notice!) That boils down to fraud. You need to report them or make sure your insurance company knows and deals with it.

Sounds like you've got some work to do.

The Bureau of Automotive Repair takes care of such things in California. Also, in CA, you can take it to any shop you like, the insurance co. cannot make you use one, they can only reccomend a shop.

Talk to the shop first. See if they will work with you without involving your insurance co. They might see your point of view and fix it without problem.

If the shop gives you trouble, the insurance company has a responsibility to return your car to its pre-accident condition, so if the shop messed up, get the insurance company to lean on them.

If you can't get any cooperation from either one, call the BAR (or equivalent in your state) and let the suits sort it out.

Call your insurance carrier. Did you pick the body shop or did the insurance company? Be honest, did you try to get a cheaper job done than what the insurance paid for so you could pocket a few bucks? You could also confront the body shop Manager about the defects.

correction- they WOULD have let you use the body shop of your choice. you CHOOSE to use their network shop. Its against the law for them to make you use one in their network and any large insurance company would NOT do that to you.

Now- with that network repair you should have a 100% guarantee on repairs.

As long as your compliants are reasonable and accident related they should get it back in the shop for you. Why arent you asking them about this?

yes they have to fix this. sounds like pretty crappy work. call the adjuster you dealt with and tell him you are unhappy with repairs and have come look at them. he should authorize the body shop to fix them.

it doesnt do much good..but first report them to the BBB..then take pictures of everything and show them to your insurance company..they should also have pics prior to the repairs and you can compare the sets of photos..
