i am a citizen and she is not. are we gonna have to wait 3 more years? i am from LA.

There is no such rule in any state, you can get married to a person of foreign origin without any problems.

If the person is residing outside the US, then you must meet them personally and have to know them for at least 3 weeks before you can apply for I-129 Fiancee Visa for him/her to come to US and get married.

If the person whom you wish to marry is already in US, you can get married and then file:

Forms: I-130 for residency application, I-485 for status change, both application should be filed at the same time in this condition, as You are an American Citizen both applications will be approve immediately.

Let's get this right.... you may get married at any time and she will get a TEMPORARY VISA, if she doesn't have one already. Hopefully your union is all in true love & bliss, as you will probably be interogated at some point (see movie: Green Card). AFTER 5 YEARS (and providing good law-abiding citizen and still married to you) she will receive PERMANENT VISA and possibly eligible for naturalization. This is all dependent on whatever the current rules are which are constantly changing due to int'l relations, immigration laws, etc. LA has a local office and internet info too!

Check the CA immigration rules i=on the website by logiing on. You will get the final answers to all your questions. Dont believe all you read here. You can get married to any one from any country. You dont have to live in a country for five years before you marry. Thats not true.

State laws regarding marriage have nothing to do with immigration law. If neither one of you is married and you have all of the necessary documents then you should be able to get married right away.

I think someone has confused common law marriage (where you are considered married if you have lived together for some time as a couple) and some other rule or they were pulling your leg.

In CA it is 5 years. There is no common law in CA
