I am one of 3 children. My parents split 15 yrs ago and I lived with dad. He remarried but his new wife made it clear that she wanted us out. Dad and I argued over it, but it was impossible to stay. We didn't speak for 13 yrs. My brother's are very close to dad and told me recently dad had a brain tumour. I rang him. His wife answered and hung up. I rang him in hospital and we chatted. He said I could visit but his wife found out & he was discharged a week early and taken home. He told me his wife did not want us to be in touch. We got back in touch via email and we started to correspond. He died last week. His wife has shut my brothers & I out. She won't tell us anything except that we are not welcome. There is to be no funeral service, no fuss. He will be cremated and she has yet to decide if she will tell us the date. He leaves a house (£250,000), 2 cars, insurance policies, & a pension. His wife has manipulated him and I fear she will get everything. Can I make a claim?

Go to a solicitor. There are rules which have to be followed when settling an estate and it could very well be that you may be entitled to a portion of the estate---whether or not he has made a will. Many solicitors have a free advice clinic so you will not be out of pocket. Please check up on this I really do think there will be something due to you by law in his estate

It will probably depend on whether or not your Dad made a will.

I would suggest contacting your local Citizens Advice Bureau

http://www.citizensadvice.org.uk/index/getadvice

they should be able to advise you of your legal rights.

Hope this helps.

As far as I am aware you can only make a claim if your dad did not make a will, this would mean his estate would be intestate in which case you can then make a claim!!
