it is in the same place on all of the pictures and is less evident in very bright areas. i thought it could be the lens but i didn't see anything. and i dont think its becuase of a mistake in the developing process. does anyone have any ideas?

Your description makes me think "scratched negative" - and don't be so quick to absolve the processing.
Open the back of your camera, hold it lens up, and use a bulb-type blower to clean the inside of the camera. DO NOT USE COMPRESSED AIR (unless you're inflating a beach ball or tire or air mattress). Use a soft bristle brush to clean the pressure plate. Be gentle. Do NOT touch the shutter curtain with anything except air from your bulb blower. Use the brush to make certain no tiny pieces of film have broken off and lodged under the take-up spool (where you attach the film leader).
If you still get the scratch you may need to send it for service. I use Garry's camera Repair (garryscamera@yahoo.com).

Clean the inside of the camera thoroughly.
If the camera is pretty old, there's also a possibility that the rubber seal is shot and little pieces of rubber are loose inside. These can also cause that kind of problem. The seal can be replace by a good repair person.

Maybe your camera strap was hanging in front of the lens or possibly even a minor crack in the lens. If it is a film camera it might be exposure.

There is a small bur of metal somewhere inside your camera scratching the negatives. Look at the negatives to give you an idea where to look inside the camera and smooth it down.
