We are trying to sell our car, to get something bigger.

We bought the car from my sister, The title is still in her husbands name.

We signed it, Just didn't get it titled in our name.

What will the person buying the car, Have to do, In order to get the title in their name?

Need answers fast - the lady is on her way to look at the car now. :(

Currently, My brother in law is not capable of going to the DMV with this lady.

So unless that's our ONLY option, It isn't one right now.

We signed in the 'Buyer' area on the front.

You just fill out the info on the back of the title - there are instructions for transfer, and no, she can go to the DMV to have it switched on her own.

I assume from your question that you have the title in your possession. If your brother-in-law has signed the title as seller, and you as buyer you're ok. The first thing you have to do is go to dmv and title the vehicle in your name. Only then can you properly assign the title to your buyer. If you don't have the title you will have to get the original title from your sister & brother-in-law. If it is lost they will need to get a duplicate/replacement title. Go to the web site www.dmv.org and click on your state to get the info you need for a duplicate title in your state.

Does the previous owner "have to" go to the DVM with the buyer? Couldn't he just give you a bill of sale?

However if your name has already been entered as the buyer on the title you will probably have to retitle it in your name then sign it over to the new buyer.

Call the DMV and ask!

You can't sell a car that doesn't belong to you, so the car will have to transfer from your brother in law to the buyer. Sorry, but that's how it goes. Otherwise, everyone would be selling everyone else's cars.
