...I like Petty but he said that he would not hesitate to switch cars if it was necessary to ensure that both Petty Enterprises cars kept lining up for the Cup races -- whether that would be at the beginning of next season or at the end of this one.

...Now is that abusing the system or should it be allowed?

And is it fair for the sponsors.

It's within the rules. It's no different from the teams that use Bill Elliott or Terry Labonte to try to make a race.

I'm a huge fan or the Petty Family, however Kyle with the exception of the Victory Junction Gang has not impressed me with his path he has chosen.
His lifestyle nearly estranged his family during the 80's. Lately I have seen him become more and more aggressive. I've stated it before here, that I feel he realizes his career is winding down and he is not happy with the things have turned out. I also think that loosing Adam has put an unbearable strain on him.
I'm sure that he is getting pressure from sponsors and that is why he is thinking of switching seats to stay in the race. I hope he does not do it and I do not think it should be allowed.

Nope. It's completely within the rules. Heck, they could put Richard in the car with his 6 past-champion provisionals if they wanted to. The top-35 free pass is based on owners' points, not driver's points, so they can put anyone in either car as much as they want.
Why do you think Elliott is in the 21 right now? Or why Terry Labonte subs in several cars? So they can get the provisional.

Best way to keep this from happening? Lose the top-35 rule.

No it is not abuse in any form if he passes the physicals and so forth. Past Champions Provisionals are allowed and so are relief drivers such as Rudd used Wallace this year. Of course the past Champions Provisional goes by most recent so Elliott-T. Labonte-D. Jarrett would have 1st shot

Just using the rules as written to make thje field. DJ used all his provisionals this year, Bill Elliot drove for the same reason.

As long as NASCAR approves, and the sponsors give approval, it shouldn't matter to anyone. I say go for it! Sometimes you just gotta do what you gotta do to race.
