Both are underage. And both have strong feelings for the other. Is it still a crime? if so, what are the punishments?

Please be serious in your answer. This is for a specific purpose. Debate on Presenting a bill in Debate team. I need info on the issue by asking others.

What would be the snetencing if poeple were to find out?

It's not a crime, but you have to be careful. If your girlfriend (or whatever) gets pregnant then you guys will have a lot to deal with. You'll find that your lives will be dedicated to that baby. Probably not something you want at this time of your life. Also, there's a lot of diseases that are sexually transmitted, so when you start having sex you're going to have to go for regular check ups with your family doctor...that won't be fun. You're also going to have to look into different methods of birth control. Sex is a big thing...so be careful and make sure you're both really ready for it.

Both would be charged with having sex with a minor, because if one or both are under 18 there is no such thing as consensual sex...you are "unable" to make the decision of consent until you turn 18. The punishment would not be considered rape, but both would be charged and might get a fine, would probably get community service, and definitely would have to do mandatory counseling.

The answer to this would probably depend upon the state. If you have been reading the news the past few weeks, there was a case of a young man , I believe he was 17 and the girl was 15, they had consensual sex. The boy was tried as an adult and received 10 years in state prison. Extreme yes, fair? I think not. But like I said, it all depends on the state and the mood of the prosecutors.

It all depends on the state, and their ages.

Consider the extremes:
If a man of 25 has intercourse with a girl of 10, he'd be guilty of statutory rape and she would be considered a victim in virtually all states *unless* they get married before it comes to trial.

If a boy of 10 and a girl of 10 were to have intercourse, neither would be guilty of a crime in most states.

On the other hand, they'd each probably be considered CHINS - child in need of services - by the child protective services, which means they'd take them away from their parents and place them in a facility for juvenile delinquents until they reach the age of majority.

Romeo and Juliet were sociopaths, I guess.

Let me get this straight since your question sucks: There are two underage kids having sex with each other and you want to know if this is illegal? It depends on the age of each one. if one is around 16 or 17 having sex with one under the age of 16, they could face jail and conviction for statutory rape. If they are the same ages chances are nothing will be done unless one is pregnant then the other's parents could be on the hook to pay child support. some states allow under age marriage in rare circumstances. 16 is the minimum in most states but a person is best to wait until 17 or older and never have sex with anything under 16 years of age if you are the oldest in the relationship.

It all depends on the State that you live in. In Wisconsin a child cannot consent to sex or sexual activity. There are specific ages that determine what behavior is prohibited and with whom (regarding age).
In Wisconsin both could be charged criminally for the sexual activity(if both under age and of comparable age) If one is older than the other the eldest will likely be charged with the offense. Usually there would be some sort of intervention if this incident was reported to the local Department of Social Services. I would suggest that you make contact with your local District Attorney's Office. They can tell you as to their dealings with the law in real circumstances rather than the letter of the law.

Uh, I think it's f'n absurd that anything to do with one's own body is a "crime." No, if you don't tell the whole earth about it or if you don't have sex with someone whose parents hate you, it's likely no one will know, since it's none of anyone's business, and I wouldn't consider it a crime at all.

The two need to use condoms. The girl should go to Planned Parenthood and consider going on the pill. They BOTH need to make sure they don't *blow off other important things in life*, like school and homework, for their young love. If the two truly love each other, they'll be able to part for long enough so they can both *grow fully as their own person*. Anyone who would allow his/her romantic partner to do crappy in school is extremely irresponsible and probably does not care so much about the good of his/her partner at all.

Depends on the age.. if they are like 12-13 they could get in trouble right along with the parents.. but I think 16 is the legal "consentual" age. The parents might get pissed and try to file statutory rape charges but I think that only applies if one person is over 18.

In New Zealand it is known as statutory rape and is treated VERY seriously. For example a young man who had been found guilty of it was stopped from getting a job many years later.

No, if your both underage it is fine. If one of the partners is an adult then it is considered as rape under the law even if it was consentual.
