My little brother was busted with marijuana. He told the cop he didnt have anything and when he got searched they found it on him. He had like 1 oz of it on him. The cop was alone when he searched him and didnt read him his rights when he was arrested. He was told he has to go in front of a juvenile judge. This will be his second time in front of this judge. The last time was about 3 years ago for fighting. He got put on probation then. We live in Pa if anyone knows Pa laws. What's the worse that could happen to him? Could he get out of it bc he wasnt read his rights?

He wasnt on school property. He got pulled over. Told the cop he had nothing but got searched. The cop did question him about the weed. And didnt read his rights.

He was questioned at the scene and at the police station about it.

Anytime you are driving a car, you are on public property and when pulled over for any reason, they can search you or your car with any probable cause, they can stop you for any probable cause. If they think they smell booze or weed, they can search your car.

PROBABLE CAUSE is a WIDE open statement and the cops use it freely!

I am sorry your brother got caught.
Luckily he is a juvinelle.
Best to start AA meetings and/or drug rehab to look good in front of the judge!!

Thank goodnes times have changed! in 1972 my friend's dad was arrested on the beach for being present where mj was being smoked, unfortunatly he was over 18, and booked, and it's on his permanent record. Be grateful it was only weed!

Was he drug tested?
will he do a home drug test and see if he'd pass?

The cop is in the right, he has nothing to lose by telling the truth,
Your brother was busted for possession and I hope that's all he gets, a little time in juvie, best to promise a rehab and/or start 90 meetings in 90 days, and set a good example.
Keep his nose and joints clean!

You only have to get your rights read to you if you're being questioned, which he wasn't (at least not at the time of the arrest) since he is under 18, and he can go to jail. In many states, posessing over three-fifths of an ounce can also lead to a charge of "intent to sell" since most "dime bags" are around one-sixteenth of an ounce, meaning he had roughly sixteen times the amount of marijuana in his posession that would normally be considered "personal use."

IF HE TOLD HIM HE DID NOT HAVE ANYTHING, HOW THEN DID THE OFFICER GET TO SEARCH HIM?
IF HE WAS ON SCHOOL GROUNDS HE CAN BE SEARCHED AT ANY TIME BY THE SCHOOLS RIGHT TO KEEP DRUGS FROM THE SCHOOL?
IF HE WAS ON THE STREETS THEN YES HE HAS A CASE.
WORSE CASE SENARIO. BE 21 AND ADMIT YOU HAD IT. 17 WILL GET A JUV DETENTION, HOUSE ARREST, PROBATION, SEE JUV COUNSELOR??? ADMIT IT AND GET IT OVER WITH IT IS A JUV MATTER AND WILL BE CLOSED AS A FILE WHEN YOU TURN 18.
