This is a trick question.... if you are an alert driver, you would have noticed that the jogger was on one side of the road and the truck was going to reach the same point at the same time as you.
You can't drive the truck and you can't alert the jogger... cuz his MP3 is cranked... so you slow down... and avoid the situation all together. It's called being attentive and alert to everything around you. Don't put your self in that situation to begin with.

I'd go for the jogger, I've seen picture's of a car who drove in a truck, the people inside the car where embedded in their seat with their safety belts still on, it wasn't a pretty picture
so the jogger would be my choice,
and using the car horn would help getting the jogger out of the way..
avoid a truck at all times
and then there's this. what is a jogger doing in the middle of the road! they should keep to the side! right?

I have thought about this before. If you are in a car and you hit a truck head on, likely you are dead but truck driver will survive. If you hit a jogger when going fast you will survive but not likely the jogger. I would try to hit the ditch. I know that does not answer your question but there is no answer to what would happen in a case like that, until you do it.

If the truck is extremely fast, then I would hit the jogger. Self-preservation, man...
Police would understand that this situation is really an accident, considering that you have the right of way.

you want to hit the jogger i know it sound mean but in drivers ed. they teach you to avoid head on collisions at all costs i know this for a fact because my aunt teaches drivers ed and is always talking to the state highway partrol and we have had a case like this where the jogger was sited for being in the road. in most states they want joggers going against traffic apposed to bikes going with it so hope that helped

Definitely the truck because if you hit a pedestrian, you're screwed when the police investigate. If you hit the truck, then it would just be a regular car accident and you wouldn't be blamed for murder, because I'm pretty sure the jogger would die from the impact of your car.
