I have asked questions before regarding my friend and this new one really has me and her stumped. In the spring she lost her newborn daughter and now after months of confusion they finally got a headstone on the grave, they had problems with spellings and color because it is a very personal and special made stone. But a week after it was put on the grave she and I went to the cemetary and found it missing. She found out through the police that the "father" stole it but had returned it the funeral home before they found him. Now the funeral home refuses to place it on the grave because he has protested against because his name is not on their. 1 He is Not on the birth certificate. 2 He did Not pay for in any way, the funeral, the plot, or the headstone. 3 She even told him may not be the father. With all that the police and the funeral home are siding with him, they didn't even charge him for taking the stone. So our question, how would another mother handle being in this situation?

This sounds like time to get an attorney. The funeral home has no interest in keeping the stone--the issue seems to be "who has the right to place the grave marker?" as well as possibly the issue of paying for the funeral.

I'm glad you are there to support your friend. It is difficult enough to lose a child without these extra hassles.

Wow, this is really sad but makes NO sense whatsoever... The funeral home and police have no legal right to be involved with the name on the headstone-if babys daddy is not even on the birth cert. and he paid for no part of the burial. From what you wrote he is guilty of desecrating a cemetary and theft...There HAS to be more to this story... is the baby daddy a cop? If not maybe he was so grief stricken the police felt badly for him, but the funeral home?? Your friend needs to seek legal advice on this, it's too twisted... Good luck

What a selfish man! He would rather see her have no head stone because he didnt get a look in! Its a classic example of someone wanting the attention rather than the poor child that deserves it! Why cant he pay to have it modified? Id say seek legal advice an d try reasonong with the funeral home, it is christian practise to do things calmly and peacfully so approach them in that manner and explain its hurting the mother not being able to give her child this to.

I would launch a civil suit against the "Father" and anyone else involved.
Losing a child is hard enough, but to have someone intentionally inflict such a malicious attack on the grieving Mother is inexcusable.
I believe she could charge with emotional distress, theft of and /or damage to property, possibly even grave robbing...
In some cases, this could carry stiff penalties and jail time.

If the Parents of the baby were never married, and he is not on the Birth Certificate, then he has NO LEGAL RIGHTs in this situation!

She DOESN'T HAVE to have his name on the BC whether he is the father or not. I would take him to court and tell him if he wants his name on the headstone that HE NEEDS to pay to have a DNA test done (I'm sure that they can find a way to do it), and if it does turn out that he IS the father that he NEEDS to pay to have the headstone changed since she already paid for the first one.

Take the reciept to the police, get a lawyer, get the stone back, and take the funeral home or cemetary to court if they will not place the stone.

She bought it, he's not on the birth certificate. He has no right to anything.

my youngest daughter and her husband lost their lst child - and neither of them are on the headstone - I think its time she seeks proper legal help - my heart goes out to her at this time of need - he sounds a real nasty piece of work to be honest
