My old landlord moved people into my fiance's and my house without our permisson. We moved out 3 months ago, and did our change of address. I had an account with National City and it was in good standing until I found out recenty by mail that it was closed because of bad checks.
Since we our still unpacking I had to look for my checks and debit card...which surprisingly our MIA. SO someone had to have stolen them without e knowing. Even though I thought I had them in a secure place.
So also, because of this I cannot open another checking account anywhere. I need a checking account now because I got a job nd eventually get a credit card. How can I clear this up with the bank? Please Help!

Well my fiance already had to file a police report before I moved in with him for the same reason. He was a victim of identity theft. So we were thinking about filing a police report. Since I don't know exactly how long my checks and bank card have been gone. Will the bank accept that as proof?

if you in fact didn't write these checks go to your bank and tell them you were a victim of fraud. They will run an investigation to see if it is true and in turn clear you of any wrong doing. But if you did in fact write these checks then you will have to paid the balance and do what ever the bank wants you to do so you can have a checking account.

First, you need to file a police report. The bank will not take you seriously unless you have a document proving that you have made a police report about the stolen checks. Then you will have to prove that the signature on the checks is not yours. The bank will investigate the signatures and will let you know if they are not yours. If the account is closed because of a prolonged overdraft- it will be almost impossible to open another account. You don't say how much money was taken, but, if you cannot prove that you are not at fault, the only way you can clear this up is to pay off the bank overdraft. Then try opening an account at a savings and loan company, where it is easier to get a checking account. You will have to take it step by step to get your credit back on track. But, if you just let it go without dealing with it, it will be years before it comes off your credit report.

You should have immediately notified the bank that your checks and debit card were missing. You will need to file a police report. The bank will investigage and if they find fraud, your bank account problems should be resolved.
You may run into problems if it's taken you three months to discover the theft. Were you not receiving bank statements? When you missed the first statement, you should have contacted the bank. Had you stayed on top of this, you would have discovered the bogus transactions much faster.

If you believe fraud has taken place, contact the authorities and explain why, have them investigate.
Otherwise, unfortunately, you will have to face up to your responsibilities and pay any outstanding fees you owe on the account. Once you have done this, you will be able to close it out. Next time, consider installing a line of credit if you think you might overdraw your account from time to time. Usually lines of credit can be had for a lower interest rate than a credit card and they are quite handy. Good luck!

You need to pay the overdraw and a possible a penalty. I had helped a friend out once that had been overdrawn and he needed to close the account for similar reasons and reopen one with a different number. Square up with the bank, be honest with them and they will help you out!

Go to the bank and file certificates of fraud on each check. They have the resposibility to not honor the checks.
