If personx steals a prescription pad from a doctors office as a past employee and has an intent to forge a prescription, fill it and then sell the controlled substance, what would be the legal charge if there is one? The stealing of the pad is actually the only thing (that I know of) that occurred. But there was intent as personx told another person what they were going to do and that person went to the medical practice and reported it. What should the medical practice do in this case?

Someone I care about very much is the one that stole the Rx pad. I will email dog lover's answer to her because I think that says it straight up and she needs to hear it. Its very sad to me that someone in my family would do this.

The only crime someone could be charged with for stealing the pad is simple theft.... Called petite theft in many states. It is a misdemeanor offense.
But, here is where it gets bad....
Fill out one of the sheets and that's forgery... Felony.
Attempt to pass it a forged script and that's uttering a forged instrument... Felony.
Obtain a script via fraud.... Theft and possession of a controlled substance.
And then you could get slammed with Trafficking, and the list goes on.
This is an insane crime that could net the person YEARS in jail time.
If it was bad enough, they could be charged Federally and that's HUGE........... decades in Federal Prison!

There are states where theft/unauthorized possession of a blank prescription form is a felony, (Indiana and Illinois for example), and the person can be charged with one count per form (20 form prescription pad = 20 felony charges)

Intent is not an element of forgery, so the only charge would be larceny.
However, intent would come into the mix if you sold or gave the pads to someone who did forge them. You could be looking at being a party to the crime of obtaining a controlled substance. This would be difficult to defend, as there is no other pracatical use for the prescription pads.

You could go to jail.
I worked for a group of dentists once. The one dentist was fired. He was caught stealing then forging prescirptions for himself. He was arrested. The ending of the story is very sad because he died before the trial.
Dont do it, or if you have a friend who's thinking of it, advise them not to do it! It will ruin your life and it's not worth it~

5- selling drus illigally
The medical practice may fire this person and press serious charges agains this person. We aren't talking about a misdemeanor here, something along the lines of a felony and crime court are totally it.
