ok i need to fax this to the employer today , but i don't know what to check here

it's asking me this

"CHECK APPROPRIATE BOX"
and the options are

Individual /sole proprietor,
Corporation
Partnership
Other &
Exempt from tax withholding


what should i check . This is very confusing because

the lady on the phone told me that the job is a 1099 status , So then why am i filling out a W-9 form ?

Probably individual/sole proprietor - if any of the others applied, you'd almost surely know it.

A W-9 IS the form you fill out if you are working on a 1099 - if you are an employee, you fill out a W-4 instead. You'll get a 1099 at the end of the year showing your income, and use that to prepare your tax return.

I. A human being with a social security number is an "Individual /sole proprietor". The other things are types of businesses with employer identification numbers. The 1099 is the form that they send you at the end of the year that says how much they paid you. The W-9 is the form that you give them now so that they can properly identify you on the copy of the 1099 that they send to the IRS.

II. They are not your employer. If they where, it would not be 1099, and you would be asked for a W-4, not a W-9. That is is 1099 means:
1) you pay self-employment taxes (15.3% of 92.35%) in addition to income taxes
2) they do not withhold anything
3) you have to 4 payments per year to the IRS on certain dates (see form 1040-ES)
4) you do not get unemployment compensation after the job ends
5) they do not have workmen's compensation coverage for you

If you don't represent any corporation or partnership, then check Individual/Sole proprietor.
Check exempt from tax withholding unless you have been notified by IRS that your income is subject to backup withholding. It will happen if you ever faulted on paying the IRS dues.
If you are an individual/sole proprietor, then fill your Social security number.

It sounds like you are trying to fill out the section that is for the employer.

You only need to fill out the top section of the form. (name, date of birth, etc). Also you need to fill out your citizenship status. And there's a place to sign.

And then you need to be prepared to present the various forms of identification that are indicated in the middle section.

The bottom is for the employer to fill out, don't worry about that.
