Who has the court-appointed legal custody? The custody remains with that person until the court legally changes it. You don't owe any child support until the court legally changes it. When your son chooses to jump from house to house, that doesn't mean whoever owns the house has custody of your son.

Well you better step up and be a parent. Kids never want to follow the rules and the reason he wants to go live somewhere else is because he doesn't have those rules there. You can let him but you better be ready to accept full responsibility when he dies of a drug overdose or something. It is much more common now then ever for kids to be doing deadly drugs. Is that what you want?

You dont have full custody untill the court orders it you need to file thru the courts. The step sister has no rights unless ordered thru the court No one has to pay child support unless ordered by court

Hi...

the only two people who have rights to custody are his parents, unless YOU also sign over legal rights.

the step sister isn't a parent... you are though.

i suppose that if the 16 year old wants to live with his moms step-sister, that's ok. have you talked to him about HIS wants and needs?

take care.

I am not sure but I'm thinking that if you are on the birth certif. and parternity doc. and you never gave up your custody rights. Then you still have the same rights as your ex-wife, when it comes to you son. Unless you fully gave up your rights as a father, then your exwife can give up her rights to someone else.

Your best bet at this point would be to get some legal advice from a lawyer. A lot of them offer free consultations.

You are the father - you should have him if the mother does not want him.
