ME and my husband who is army active duty are going to separate and divorce. Am I entitled to this comming income tax return and if u can please include a website thanx.

Only if that was part of a divorce settlement. And I would say that it would be very surprising if any judge ordered this....your husband is the one who is working and earning the money. The income tax return is just the return of the money he has overpaid in taxes....therefore HIS money. You are only entitled to what the court awards you, which will be a fixed sum per month. You don't say whether there are children involved, but I would assume that there are not.

So, the short answer is NO, you have no claim to half of your husband's income tax return.

It will depend on a lot of factors. Including if you live in a Community Property state. Were you still legally married at the end of the year. What percentage of the income you provided for the household.

Below is a link from the IRS that should help you. If you have a lawyer this is defiantly something you need to bring up and make sure it is specified in the divorce agreement.

It depends on if you are married or not by the end of the year. If you are not, then it depends on your divorce decree.

If you are still married at the end of the year, it depends on how well you and your soon to be ex get along. There is no legal requirement to split a refund claim check.

There's no legal requirement that it be split. If you file a joint return, both of your names will be on the check, and you'll both have to endorse it to cash it. The way you split it is up to you unless it's determined in the divorce agreement.

both of ur names should be on the check.
until u are divorced u own half refund.
