can the school get in trouble for not giving my brother his meds like they are supposed to? just wondering, he is supposed to get them at a certain time every day, they know this and they arn't giving him his meds! what can we do and are they aloud to not give them to him?

If you have documents from doctor, you can sue the hell out of the board of education!!!

I would start with having one of your parents (unless you're his legal guardian) call the principal to find out why the school nurse (or whoever they put in charge of your brother's meds) isn't doing their job. If you're not happy with the response, contact the district's superintendent. If still not happy, contact a member of the school board for resolution. If still not happy, contact your local council person...they don't really have anything to do with the schools, but they might have some pull that your parents don't.

I doubt you want to contact the newpaper or TV stations because your brother probably doesn't want everyone to know he's on medication. That might even be why he's not getting his meds on time (privacy), but it sounds like you think he's not getting them at all. Maybe his doctor needs to review with your family and the school how much leeway there is on timing his meds.

I put glue on a desk and someone sat on it. It was Elmer's glue and it could have easily been taken out if you washed your clothes. The person who sat on it should have gotten in more trouble then me though because he was rude, always making fun of other kids, and didn't listen to our sub [basically, the whole year we had a sub because out teacher was pregnant at the time and EVERBODY was goofing off.] I was really stupid. That was back in 6th grade. Got suspended for 1 day. I learned from that lesson! This year though, this girl got suspended because she drew...uhhh, a male's part all over the bathroom. It was funny but I still think she's stupid for doing that...

If there is a medical note stateing from a Doctor that he needs these they have to give them to him. You need to contact a department of Human services or get a lawyer if you have a signed medical stement. If you do not have a signed document from the doctor they can't legally give a child meds.

I think there might be too much of a liability in them doing it. Think about it, if a teacher touches a kid on the shoulder to get their attention they could get sued for sexual harrasment, or assault in today's America. If I was the teacher, there is no way I would agree to give your brother medication. Sorry, but I'm not the one you have to thank for that.

Yes, write a letter to the State Board of Education, with copies to the county board of education and to the principal at the school. You could start at the bottom and go up, but why waste time.

Yep...contact school board and you might even call the Child Protective Services...after all...you brother is in danger from not getting his meds and they are suppose to be responsible adults and take care of him.

Change his schedule of meds to take them before he leaves for school. How often does he need to take them? Parents need to go to the school taking all of the meds with them and discuss what their child needs if his schedule can't be changed to take them before he leaves for school.

If he is prescribed medication and the school is aware....... YES.... they must follow the prescribing Doctors instructions.

Listen, they are opening themselves up to huge liability if they do not.

Have your parents call first the principle and then the Superintendent of Schools for your local school board.

They will remedy this situation.
