by ambulance......he was driving under suspended license , no insurance,did not pass drug test and drugs were found in car~~~so we are trying to heel up and need to know whats next we do carry uninsured moter veihcles insurance so opinions plz

Well, with the info you've given us...it sounds like you are in good shape.

Uninsured motorist coverage takes the place of the other party's insurance should he have carried it. So, the way they will treat you will be similar to if you had a bodily injury claim with another insurance company.

They're going to wait until each party is done treating at the doctor (hope you guys are all alright). Then they will weigh the injury against the impact to the vehicle and offer each person an independent settlement. No funds will be exchanged until the parties 1. finish treating , and 2. sign a waiver of additional liability (meaning they will not pay any more funds after you sign).

There is no "equation" or special formula for the amount of money you are going to be paid, despite what anyone will tell you on here. Treat with a doctor for anything necessary, and no more. Hiring an attorney is not advisable unless you're prepared to give them 33% or more of your settlement, and/or you are so handicapped from the accident that you really need legal assistance.

As far as the car goes, you would also need uninsured motorist property damage for this and depending on your policy and what state you live in there may be limitations to what you can be paid. If your car was totalled you will get it's ACV (actual cash value), which is basically fair market value less depreciation and based on your specific demographic area. Your claims adjuster will be able to review this further with you.

Talk to an attorney. See if one will take the case on a contingency basis. (I.e. the lawyer gets paid only if he wins the suit against the insurance company). Did she have medical insurance that covered part of her medical bills? If so, her health insurance company is likely to sue to recover what they paid. She should receive an amount that covers her part of her medical bills.

I would call my insurance company. Also, he liable for medical bills, maybe more.
Your insurance should take care of things and drill his butt, so this save you the headache of getting blood from a turnip.
I too carry uninsured motorist, well worth the little it cost should you need it.

what are you worried about? you have Um coverage.. all your medical bill will be paid to yoru limits. If you daughter and you are PERMENANTLY injured.. meaning youll be disabled for your lfietime... youll be owed more then medicals.. but if you get better... wont you just be happy to be better and get your bills paid? dont bother with a lawyer.. it always cracks me up when people run to them.... if your not SERIOUSLY injured.. why would you give away your money when any intelligent person can handle it themselves?

call your insurance.. they are there to help you and will explain how your bills get paid.

First insure that you are all physically OK for the long term.

Then contact an attorney that specializes in dealing with insurance companies. It is a real legal quagmire that a novice will never successfully deal with.

You shouldn't get more that you deserve, but you should get all that you deserve and a lawyer will help you achieve that.
