i am 16 my grandmother recently pasted away my uncle and aunt have temporary custody over me.i love them but i would prefer to live with my biological mother.can she take me without going to jail beings how i am legal age or does she have to consult someone before i leave with her.

YEAH,SHE SHOULD REALLY CONSULT SOMEONE SINCE YOUR AUNTT AND UNCLE HAVE CUSTODY OF YOU. YOU MAY HAVE TO GO TO COURT THOUGH,YOU ARE OLD ENOUGH TO SAY WHO YOU WANT TO LIVE WITH.

If your grandmother had legal custody of you, and now your Aunt and Uncle have legal custody of you, your mother would have to file with the court to get custody of you. You aren't "of legal age" until you are 18 years old and an adult. By law if you are in the legal custody of someone else , no matter who takes you without permission of your guardians can be in trouble for kidnapping. Have you tried talking to your Aunt and Uncle about the situation and that you want to live with her and not them right now? Perhaps if you all sat down and talked it through you could come a compromise.

If your your aunt and grandmother have temporary custody that means there is a case in family court. and by your mother breaking any rules the judge gave she can end up in jail. by law your not older till your really 21 but by most 18 your still under age welll in new york state . It's what the court papers say that your mom has to follow. talk to your aunt and grandmother to see what the court has order and why?

She really should consult with someone before you live with her. Your aunt and uncle could file you as a runaway if you were to just leave to go with your mother or even go so far as kidnapping against your mother. In this case your not of legal age until 18.

when my son was 14 he was able to say who he wanted to live with. (i live in texas). the court would listen to this provided there was no objection for good cause (ie. the chosen parent was not unsuitable and provided a good environment). if one of the parents or custodians objected there could be a hearing. otherwise you should be able to voice your preference. if your aunt & uncle object its probably for a good reason - perhaps for things you know nothing about. talk to them. think things through carefully, make good choices.
