In California, it is definetly illegal.

The law, basically states that no vehicle may pass a school bus, in EITHER direction, when it's red lights are flashing.

This does NOT apply to vehicles approaching from the OPPOSITE side of a multi lane or divided highway.

On a two lane road, all traffic is required by law to stop until the bus's lights quit flashing.

On a divided highway, one with a grass or concrete median, the opposing traffic is not required to stop.

Yes it's illegal, but in order to do anything you must get the license plate number and a description of the driver. I had a similar problem with my daughters bus stop and the police told me they couldn't do anything without the above information. Hope this helps.

In the UK, the car would be driving up the pavement (sidewalk) to pass the bus on the left. We drive on the left and call the bit that people walk on the pavement, I know this is strange to you americans, but we invented this language.

Sure signal, that way the bus driver knows to pay more attention to you and get your plate. The stop sign is extended YOU AREN'T ALLOWED TO PASS. They can pull off the road WITHOUT extending that sign.
