Father in law emptied out bank accounts illegally (son was left everything and is exector of will) we cannot afford constant legal battles. Can we have father arrested for this? Mother in law knew this might happen....hence why she didn't leave her spouse anything. This is in georgia.

Please talk to a lawyer for advice. I'm executor for a deceased relative, and if something like that happened to me, you can bet I'd talk to one.

If she had a Will, and if you can come up with bank statements from the day she died, then your father in law will probably have to come up with the money and return it.

If the accounts had his name on them, and the accounts said "Mother's Name AND Father in law's Name" well, the accounts belonged to them both and there isn't a lot you can do. When there are bank accounts with the word AND between the names, if one person dies, the money is legally the other person's... same for a house deed etc. It is a technicality and people do this in case one dies... that way, the moneys do not go through probate.

Talk to the estate attorney.
