i live in ontario, is it illegal to take someones photo without their permission or with them saying they dont want that pic taken? im not professional, photography is just a hobby but these pics will go onto my facebook. is that illegal??

kay its not for news its just for me i like taking random pics and i like putting them up on my facebook cuz i want to show my friends do i still need their permission?

If it's for news and they are in public, you can take their pics no matter what. Look at all the paparazzi craze in Hollywood.
If you are using the pics for personal or for sale then you need their permission. I think facebook and myspace don't count as news media.

I don't know about Canada. In the US, it is not illegal to take someone's picture if you and they are in a public place that has no expectation of privacy. So at the carnival or a ball game, yes. In the doctor's office, no.
The bigger question raised here is one of ethics. If some one tells you they don't want to be photographed, why would you take their picture against their wishes? And then post it on the web? Compounded violation of ethics and common decency and courtesy. Also there is a possibility that somebody might get physical or violent if you ignore their wishes. Is it worth taking a chance? I guess you'll have to decide.

If in a public place, then it's legal. Even if they don't want their picture taken. Even if you shoot through a window into a shop, it's still legal. As long as the person can be seen from a public area, then it's legal. That's why paparazzi get away with it. The only time it becomes illegal is if you publish it with a story that is untrue.

If the photography is used for "news" value, then you are safe. If it is used for any other purpose, you may be up against privacy issues. If you are intending to print the picture for public view and/or sale, you definitely need a release and must show consent.

as long as the picture was taken in a public place it's totally legit. Only when you plan on making money you need their consent. Snap away!

yup sorry to say this but yes
ps its not necessarily based on your states law either - remember facebook is located on the net but it has a specific base of operations and the law could be different so you need to search around
why you want to take peoples pics without there permision anyway?
