I am currently getting ready to enter a no contest to a misdeameanor plea of resisting arrest. There is no Jail or probation time in the picture the DA said they will drop another massive charge. plead to this one and pay a fine. How do I get this dropped from my record?

Short answer: You don't get it off your record.

A "No Contest" plea means you are conceding that the DA has enough evidence to convict you. It has the same consequences of a guilty plea.

On the plus side it is only a Misdemeanor conviction, not a felony. So it does not affect your constitutional rights like a felony conviction would.

Expungements are not something you can get right after the incident. In most states, it is the State's Parole and Probation Boards that recommend expungements to either the Governor or the Court. The main thing they look at is the seriousness of the crime, what your behavior has been like since the incident, the length of time between the incident and your request.

I suspect you can not get an expungement for a couple years, at least.

It may be difficult since you are doing a plea bargain. Usually it takes 5 years to get something expunged from your record.

if you have a clean record up to now see if they have a first offender program that you can participate in that will clear your record when you complete it
