I have recentley been done for drink driving.
My reading was 0.107. I have had no previos convitions in Queensland though I was convicted of drink driving in NSW over 8 years ago.
Has anyone been in a simular situation if was happened.

It doesn't matted if your last DUI was 50 years ago you didn't learn the first time. They are going to charge you as this is a second DUI not a first. This time you will get more jail time then the first one.

Your reading is mid-range. I assume you have already had your licence suspended given the reading.

You will have to go to Court and you will definately lose your licence for 12 months because it is your second offence regardless of the state in which it was committed. The Police Prosecution will have your criminal history from all States. You will probably also incur a fine of about $1000 given its your second offence.

I am based in NSW, so I'm not 100% confident of QLD Law but it is similar sentences with PCA offences. You should get a good solicitor to represent you so that you get the minumum sentence (say, 9 months loss of licence insstead of 12 months) if you have good reasons why you need a licence. (In NSW, work reasons don't count, I'm not sure if it still applies in Qld - check it out). Hope this helps
