The person who is not wearing a seat belt will receive the citation.
Edit. The driver will receive it if the passenger is a juvenile.

In my state the driver gets the ticket because he is responsible for all the people in the vehicle.
A couple of months ago my friend was driving and my daughter (who is 18 and a licensed driver) got pulled over because my daughter was not wearing her seat belt. The officer wrote the ticket to the driver. It is only $25 here.

In Ontario, Canada:
The driver gets a ticket if he/she is not wearing a seatbelt.
The passenger will get one if he/she is 16 or older. The driver will get an extra ticket if the passenger in under 16.

Only the passenger gets the ticket, but if the passenger is a under 16 than the driver gets it.

If the passenger is over 16 years of age and isn't wearing the belt, the driver is off the hook.

if the passenger has no seat belt on they will get the ticket if they have a license....the driver gets it if the person is under age or doesnt have a license

the driver and possibly the passanger... i got an open container ticket because my passanger was drinking.. he did not recieve a ticket... the officer told me that i was getting the ticket because it was my car and i was allowing him to drink.. heck i didnt even know they had passed that law here!!!

Last Memorial weekend my boyfriend and I were pulled over because he wasnt wearing his. He got the ticket, it was like $80 or so. I always had heard the driver was also ticketed, I wonder if it is up to the cop.

The driver gets the ticket because he is responsible for the safety of the people he is driving around. I know people that didn't pass their driving test because they turned their vehicle on before the tester put their seatbelt on.
