Can Someone Sign a Bill of sale if the car is not in there name?

And i Had payed him 1000.00cash. can i take him to court to get it back?

Get it back, that makes no sence i could have wrote you out a bill of sale and it still would'nt be legal

no. that would not be legal. the owner must sign as well as the purchaser. is someone else other than those 2 sign, the title is null and void.
