No. The new 40GB model, (as out here in the UK) does not support backwards compatibility and upgrading the firmware wont help.
If you want b/wards compat. buy the 60GB in the UK/europe or 60/80GB models for the US.
I repeat, the 40GB doesn't support PS2 games at all!
If still you doubt, visit the official PS site;

The new 40GB PS3 DOES NOT have backward compatibility support for PS2 games. It will not be made available either. The 60GB version does through hardware, full hardware support for backward compatibility.
If you're looking to play PS2 games on your PS3 then you'll want the 60GB version.

they took out the emulator so it cant play ps2 games.
if you dont have any ps2 games then get it. if you have ps2 console then buy 40gb or you can get rid of the ps2 and get the 60 or 80gb but the 60gb is harder to find now.

The new 40GB PS3 DOES NOT have backward compatibility support for PS2 games. It will not be made available either. Even if you upgrade your version, it sill won;t work so I suggest you buy either the 60 or 80GB if you want to play PS2 or PS1 games. If you are still in doubt visit this site:
