on friday i seen my doctor,she wrote me out two prescriptions, I take them to the "kroger pharmacy" in covington,ky the man filled my prescriptions I take them for two day's,then on monday evening the kroger pharmacy calls said one of the prescriptions they gave me,Was the Wrong Medicine. they said it was the Doctors fault because the pharmacy coudent read it. I'm ok but Pissed what should I do next? I have thought about filing a lawsuit, so this can not happen again,the thing that angered me is the pharmacy say's bring it back,we'll give you a 20.00 gift card for our mistake, I need serious advice please.thank you

you need to def do something about this. if the people filling the med couldnt read it, then THEY should have called the doctors office. but i think both are at fault, but mainly the kroger pharmacy. you could fill out a lawsuit or call an attornie, there would be no harm in that. make sure to seek legal advice. It does not matter whether they can read them or not...if they can't they are supposed to call your doctor. That is on the pharmacist. So for them to blame it on the doctor's office only further proves their guilt...and their faultiness...so I would start by contacting a malpractice attorney...do not take the prescription back until you talk to the attorney (unless you already have). They will be able to give you some advice. It amazes me how lax some of these places have become and it is going to take a lawsuit, or worse, someone dying from being given the wrong meds, before they take a little more time and do what it is they KNOW they should do! Please don't waste any time...contact an attorney right away...and ask the pharmacy for a copy of the script that you gave to them. Don't let them tell you that they don't have it because they keep them by scanning them into the computer so they can run you a copy of it. And do not settle for the gift card either. I am telling you all of this because I am a nurse! Best of luck to you!

P.S. Most doctors write the way that they do so that no one can forge phony scripts...so I am sure more often than not, they can't read the doctor's writing...makes you wonder how often they give out the wrong scripts. Have you ever heard the stereotype that all doctors write sloppy? There is a reason for that!

Probably not a whole lot to be done (assuming there was no physical harm done to you) legally, but you should still consult them. But first, find out what you should have been taking (and in the future know what your dr is scripting for you and why you are taking it), find out what they actually gave you and any ill effects for taking it when not afflicted for what it is intended to treat, any possible interactions with other medicine you are taking. Do not accept the 20 gift card until you have spoken with an attorney. And do not sign anything to accept the 20 gift card (could be seen as a legal settlement if the language is just so) and be sure to contact Kroger Pharmacy Corporate office with this issue if you do not retain legal counsel, you will probably get more response and also let them know of a problem (Kroger is one of the largest chain pharmacies in the US) and may get you more of an incentive to stay with them. I would say it is equal fault with the heavier burden on the pharmacy for filling an unclear prescription and giving it to you without verifying with the Dr, if the writing was that illegible. See if you can get a copy of the script, make sure it was illegible or if they just gave you somebody else's meds by accident, they could be lying to you on the why to defer blame. Also, if it was Doc's fault completely than how did they know they made the mistake to call you and have you exchange meds? Good luck

Well, unless the wrong meds aggravated your condition or caused another ailment, you won't have much to stand on with a lawsuit. Even if they did, you still have the burden of proof. While I agree this is a serious issue, the truth is, you probably wouldn't get much out of a lawsuit for your trouble.

As far as just making a point so it won't happen again, you should probably just make a written complaint to the store GM and copy the corporate HQ. Explain 1. What happened, 2. What you want (an apology?) and 3. When you expect to get it.

They ARE obligated to give you the right meds without charging you again,(and should refund you any difference) and while a gift card seems kind of cheesy, it's better than nothing, I suppose. I'd still complain, though.

What I want to know, is how did they come to realize they gave you the wrong meds? Handwriting is not an excuse - the doctor has a telephone and can be contacted that way if the pharmacist has questions!!

The first thing you need to do is be sure YOU can read your scripts before you leave the docs office so that you know the script matches what the doc said he was ordering for you. If YOU CAN'T read it then ask him to print or write it or fax it to the pharmacy so there is NO MISTAKE. As for a lawsuit I am not sure that is the way to go as everyone is at fault here. The doc for not writing legible, you for not checking to be sure you could read the prescription and the pharmacist for filling the script when he couldn't read it. He should have called the doc and asked him what he had written.

hi ,i am new here and just wondering what should i do when my mother inlaw was given med prescription from her doctor for high blood pressure 1 year ago.drugs run outs and recently she call her doctor & even not seeing him,she was given prescription on drug that twice as much pills she has to take & got her self into emergency last week,.luckily she survive & was told by the doctor to cut down the pills and see what will happened.she was back to normal then. so my question is, should the doctor check her first before giving out prescription or is these the normal practice from doctor?

In terms of a law suit, you don't have a leg to stand on. You need to prove harm. The fact is sometimes pharmacies get very busy. People get upset if we make them wait. So, over time people have determined that speed is more important than quality when it comes to pharmacy.

Its pharmacological malpractice - its the pharmacists responsibility to be able to read it, or clarify what it is before they fill it.
We covered that in class today - but filing a suit isnt going to make it never happen again - it happens a lot more often than you might think (about 5% of times) - as long as you are ok, I would ask yourself if you want to go through the bother.

I HAD AN EXPERIENCE LIKE THAT AT WALMART. I GOT THE RIGHT PRESCRIPTION FREE. (THANK GOD I DIDN'T TAKE WHATEVER THEY GAVE ME) I WOULD CONTACT THE KROGER MAIN HEADQUARTERS FOR YOUR DISTRICT. (CINCINNATI ?) TELL THEM THE WHOLE STORY, AND SEE WHAT THEY HAVE TO SAY. THERE SHOULD BE A CONTACT US PLACE ON THEIR WEBSITE. DID YOU FIND OUT WHAT THEY GAVE YOU TO MAKE SURE IT WAS SAFE FOR YOU? IF THE PHARMACY COULDN'T READ IT, THEY SHOULD HAVE CONTACTED YOUR DOCTOR.
