Last month I was pulled over and found out my license was suspended. I was never notified by DMV or Child support. This was not suppost to happen as I have full custody of my son now, but there was still an open child support case against me from when he lived with his mom. Since then I have taken Child Support to court and was able to have my case closed so they have released my license. This is my first offense, well misdemeanor. I've had speeding and seat belt tickets but nothing this serious. The police officer didn't arrest me or impound my car, she said because I was unaware I was suspended that they can't take me in, so she had me call someone to come pick up my car for me. Do you think I will go to jail for this since it is my first time? Im in California.

It is very unlikely that you would go to jail. In fact, unless they can prove that you had knowledge of the suspension (for example, by proving you got a letting notifying you of it), they cannot convict you of the offense. Because of that, if there is no proof that you knew of the suspension, it is very likely that you will not even be charged. If you are, remember that you have the right to appointed counsel if you cannot afford to pay an attorney.

I suspect that since you have now taken care of the matter, you will hear no more about it.

First offense...no way. And if have your proof the child support has been taken care of and you have custody of the kid, they may drop the charges, it's worth a shot, if not you will have a fine.

You will not go to jail. If you were going to jail it would have already happened. Good luck raising your son, and sorry to hear about the harassment you have faced from child support.

No. The most you will probably get is a fine. Don't sweat it. Just don't get caught driving on a suspended license again.
