my ex and i decided on a custody plan. i got all the paper work from his lawyer in the mail on Friday i dont completely understand it all and according to his lawyer i cant ask him becuase he represents my ex. i talked to my tax lady cause the papers say i can claim her as a dependent this year and he can claim head of household, but he has to have her a certain amount of days to do that, she was born in July and resides with me in October we started the 50/50 custody, my question is if i called like legal aid or some place that offers free lawyers would they sit down and explain everything to me i'm not looking for someone to represent me, just look things over cause i dont think its very fair he could claim head of household when she was with me most the year until half the time this month. i'm just confused. he already got off easy and only has to pay 55 dollars a month in child support...help!

i actually dont think its unfair he only pays 55 in support i think its unfair he should get to claim head of household when she was with me...sorry didnt mean for it to sound like that. i just meant he should be happy with that.

It is true your ex's attorney cannot explain what the papers mean - that would be a violation of his/her cannon of ethics. You should definately call Legal Aid. They will likely give you legal advice, not tax advice, but they may be able to help you negotiate your position as head-of-household. Divorce will probably be one of the hardest things you will go through in life. Good luck and remember, this too shall pass.

Yes, most legal aides will help you with something of this nature,,, the will also represent you if you have to go to court, as long as the other party hasa lawyer.. And no. he cannot claim her for taxes if she has lived with you for more than half the year. My sister in law cant even claim her child because she was pregnant, and had the baby well after half of the year, even though she was pregnant for most of it...Call some one and they will help out.. don't sign any papers that you do not fully understand because there could be things in there, such as revised visitation and what not that he didn't tell you about.....GOOOD LUCK..

$55 a month in child support... he's getting off easy! You should not bear the full financial responsibility of raising your child. My advice would be to look in your phone book and find a lawyer that does free consultations. You can also look for the Lawyer Referral Service in your area and they will refer you to a lawyer near you that has agreed to do consultations at a lower rate (much lower than their hourly rate). They can look over the agreement and answer any questions you have about it.

Click on your state and you can look at the child support guidelines for your state. Some states have calculators or worksheets on their website so that you can calculate what amount you should be getting.

Yes legal aid will help you just have the paperwork you need explained with you. Be there early so you can have first chance to talk to them before others get there ahead of you.

Shoot...55.00 in child support. My ex was ordered to pay 600 and he owes 20 grand...

Hey my dad paid $55. a month in child support. That was 52 years ago too.

Call legal aid, if they can't help they should be able to tell you where to find help.

you should not go along with something you do not understand. you need legal counsel to explain it to you. you can try legal aid but that might not work. try a friend who is a paralegal or attorney.
if you are sharing custody 50/50 i don't know why you think it's unfair he only pays $55 a month in child support...???

Don't worry about him getting tax breaks. I'm sure he can find other things to deduct too.
You should also be able to able to deduct head of household.
Find legal advice to help explain it BEFORE you sign the agreement.
