My wife and I are both in the army. I am in Korea while she is in the United States. The finance guy told me we should both get non-dependant BAH and I should get FSA aswell. Could someone please point to a current AR that addresses this?

The best way to get the truth is to go to Finance. They will go over your LES to insure you are getting what you need. If you are not getting what you need, they will fix it and give you back pay for what ever you was not getting. So act fast and good luck.

I am not sure on this since it might have changed but I was in the same situation and while living out of military quarters we both did collect single BAH, I know that is still correct, but when I went overseas and lived in the barracks mine stopped but my wife's still continued. I was provided housing so did not rate the single BAH since I was not maintaining a household at the new location. Gong to legal if the financial section gives you same answer really does not do any good since the regulations will state that and the "common sense" answer would be what the reg says (I am fairly sure that the way it was done still correct); your spouse is getting single BAH for the house but since you aren't maintaining one you won't. The FSA is correct as you are separated. The finance person who told you that you both get it; was that after you got to Korea or while you were in the States together living off base? If he is correct and it changed then talk to your pay clerk.

I agree with SSG Schramm, check with your finance office. But I don't see why not. You have two separate households so you should have two separate BAH. Of course, because you are in Korea you will (should) get the extra benefits.

If you don't get a satisfying answer from finance, try legal. And check out the link below for some ideas, it's referring to FY 05 but the info could be useful.

you each qualify for Single BAH. FSA is iffy, some commands authorize it when spousal co location is not authorized.
