Ok, I will try to make this long story short. I was married we had a child. He then started to steal my money and use drugs all day. Totally changed and didnt work was a getting trouble with the law and so forth. We did get a divorce. The judge didnt give him any rights to our child because of his history. Now 3 years later his mother wants to see the child. The mother is writing letters to me and there are not nice ones at that. She use to talk to the child then would sneak her father on. Our child now has issues. She holds her self from going to the bathroom everytime she hears their names. I got a letter now stating the the grand mother wants my child to visit her, we do live in diff. states. She has stated she has been around the house and said she will do anything at cost to get her. She calls all the time and wants to talk to the child, the letters dont stop. I want to put a restaining order on her. Will the courts let me? DO we have to appear in court? How does this work?

Well as long as they keep escallating their harassment of you and your child, then I hope that the courts WILL allow a restraining order. So I certainly would explore that as a possibility.
But before you go to the trouble & expence, I hope you will make some effort to make arrangements for visitation that is suitable & safe for everyone concerned.

I have heard (By watching Dr Phil on TV) that there are private agencies that specialize in facilitating this kind of thing.

I hope that you and your ex family can work things out for the sake of your child. Grandparents usually want desperately to be involved with their grandchildren because they know they have something precious to offer the children, & it's heavily laden with loving & nurturing.
You don't want to rob your child of the chance to get some of that do you?
I hope you will give them a chance, by setting clear, safe & healthy boundaries, & I hope that they will prove to be worthy of that chance by faithfully adhering to the boundaries that you set.

You can put a restraining order on anyone. I hope you kept all of the letters and voice mails. You can let the judge hear her going off and read the crazy letters. She's the reason why her son does drugs. Usually people who have messed up childhoods gravitate toward alcohol and drugs. Stress this to the Judge that she does not honor. Visit agreements and sneaks her son over for visits. Then tell them about daughters bathroom dilemma. You should be ok.

Visit the police and bring the letters. If your child's father doesn't have any legal right to see her, then bring the court orders with you. Make sure they know she threatened to do anything at any cost. You may need to move.

i do believe that the only way a grandparent can get visitation rights is if the child's father is in jail or prison for an extrended period of time.

your best bet would be to talk with a family law attorney. many give free consultations so you can shop around... also ask people you know about attorneys.

Good for you! It's great that you want to protect your child. I'm not sure what the protocol is, but I would definitely speak with the police.

Normally, I would say, let her have supervised visits, but if this is effect your daughter negatively I completely agree that you shouldn't involve her in your daughter's life.

they will explain it to you so get down there right away. dont ask questions just do it.they sound nutty and your child seems to be taking the pain so run dont walk.
