I recently got arrested and charged with minor consumption for blowing a .007 on a breathalyzer. I am supposed to be meeting with my probation officer on Thursday. However I hadn't been drinking, I merely had cough medicine a few hours earlier. I failed to mention this at the time of the arrest (I was pissed off, and a little shook up from the wreck that took place beforehand). Should I fight this and tell the probation officer the truth? I'm afraid they'll wonder why I didn't tell them this when I was arrested... Is it worth it?

I did not say that I blew .07, it was .007. Which is a big difference...

If you took enough cough medicine to blow a point .07, you deserved the DWI.

It doesn't matter where it came from, you had way more alcohol in your system than is allowed.

It would take 4 bottles of cough medicine to blow an .07 , plus one more bottle for every hour since you took it. "A few hours" as you say, would be 7 bottles.

I would suggest showing a receipt for 7 bottles, or come up with another plan.

It is not physically possible to blow a .07 after consuming a couple of teaspoons of cough syrup "a few hours" earlier.

There is something left out here.

absolutely you should fight it..i used to have a home breathalizer where i had to check in three times a day for 8mos. the only time it would pick up any alchol was when i took nyquil and some other prescription medicine. it even picked up chewing gum though the gum was .oo1 but stil was something..get a lawyer because they will tear that officer a new one...such as asking when was that particular device calibrated and other question you wouldn't imagine. I dont want anyone going through what i went through..good luck pal.....dont go with a public defender...invest 1000 bucks or so its worth it

If you can convince them you were gulping cough syrup by the quart, give it a try.
