You will have to prove that he is being abused in order for this to happen. He needs to talk to his school counsel, teacher about what is going on, they have to report it to the authorities. It could take some time, but if it is that bad, then the courts will step in, and you just need to be there when it happens.

It sounds to me that he is being abused. Both physically and emotionally. I would be interested to know why they don't want him talking to you? You could make a referral to child protective services. They absolutely can not reveal who made the report to them. I can't imagine any other means of getting custody of him because his parents are going to have to be shown to be unfit in order for you to get custody. You could maybe talk to his teacher at school as well. Just tell him/her that you understand he/she can't talk to you about your nephew but that you are concerned for him for the following reasons and would just appreciate him/her keeping an eye out for problems. The only other way would be for your nephew to tell a teacher about what is happening to him, because they are mandated reporters and would have to report it to CPS.

He's not being abused since you said "i know their not neglectin him" and it is not against the law to spank a child. its also not against the law to yell at a child. well you could sue for custody of him but more than likely you won't win.

no your cousin is not being abused. it seems like he lives in a decent household that can afford things his parents probably want him to be in line and keep in check.
