If I had been the manager not only would your tap been on the house, I would have given you a gift certificate for a free dinner.

If you had sued, you know the ONLY people who would have been "enriched" by it would have been the LAWYERS!
You were correct to report the item. The restaurant was correct to "comp" your meal. I'm sure the manager is ALL OVER the food prep area, especially the item in which the glass was found. They don't need bad publicity nor bad "word of mouth."
Unless there was some sort of severe injury (i.e. swallowed the glass, cut the throat, go to hospital, medical attention... medical bills), then a report should be made to the company along with a request for them to cover your medical bills.
Our society has become way too litigious, and showing restraint as you did, was commendable. As I said, if "damages" were severe, then medical bills should be covered. But all this "pain and suffering" and "mental anguish" is just another phrase for, "Hey, I'm the lawyer here, and I want MONEY!"

I think you did well, accidents happen and there's more in this world than money. I think it's ridiculous that people sue for millions over such kind of things... glass would scare me (more than a bug, mouse, chicken head and those other things you hear about) but I still don't think I'd do more than report it... and I think it was a very nice thing to tip; most probably it wasn't the waiter's fault -easily seen if the dish had a chip, then the waiter probably banged into something without bothering to check, but most of the time those things are in the supplies- so he still did his best job to serve you, and he shouldn't be shorted because a supplier's product.

The main thing is that you told the staff. If you had decided not to say anything, that would be bad as more pieces of glass could have been in the rest of the ice cream and somebody might have been more seriously injured. Doing what you did meant that the staff had the opportunity of checking the rest of the ice cream for glass.
As for making a legal issue out of it, you woul not have made money out of it; you would probably only have caused the owners to be fined, with no benefit to you.

We had a similar experience at a Japanese restaurant one time. Glass in the rice. We just reported it and the meal was on the house. They had to make a new vat of rice, not knowing if there was more in there.

Some people would sue their pants off for that.
Take photo of your friend's bloody tongue and the piece of glass. Report to the manager and get free meal plus complimentary desserts. They should pay him for doctor's fee and give you a complimentary (free)dinner for a future date. Tipping is out of the question. No tip. If they don't make good amends, you should have reported them to the Food/Health Dept.

I would stop eating the food of course.In a case like yours, I would simply have told the manager so he could check for any more broken glass. Did you check your serving dish to see if it had a chip in it?

I think you did right..and the restaurant did right by comping your check. That was the right thing to do.And it was nice of you not to get all upset.If I was in your shoes that's what I would have done..but I am wondering..did they offer any medical help?

with something as dangerous a glass i would have called DHEC. hair or something of that nature isn't so bad, but what if it was for a child. this is serious, obvious they aren't cleaning up after breakage like they should.
