Make a long story short ex boyfriend has been using my account information fraudelently. We were together for three years and of course during that time he had access to my information. I discovered recently he's been trying to open CC's in my name. Even a Victoria secret card to buy some girl underwear. Used bill me later with my info to book hotels..etc. I have filed a report but it will take a while for the investigation to go through. He's telling me he will show up at my house after the weekend after I told him not to ( have proof.) If he comes to my house could I have him arrested? The identify theft won't come into play since they are still investigating. What do you suggest I should do in this situation?

Have him arrested also for fraudulently using your name, cancel all credit cards, contact all credit bureaus and put a fraud alert on you account and get a restraining order against him.....good luck!!!!!

First of all, do you have a safe place you can go over the weekend, or at least somebody who could stay with you? (even your local domestic violence shelter/hotline can help if you feel you have reason to be afraid of this creep). Then, go to the courthouse first thing Monday morning to request the restraining order if you feel at all that he may be a threat to you. Immediately contact any company that you had a credit card with and tell them you are the victim of identity theft and need an immediate stop put on your account, then contact the credit bureaus next week as mentioned in answer above. Also for your to-do list next week, get an HIV/std test - if he's using your id to buy lingerie and hotel rooms, it's hard to say how long he'd been cheating on you before you broke up.

I'll probably get some heat (no pun intended!) for this part of my answer, but I stand by it: the next thing you should do is sign up for a personal self-defense class and a firearms safety class, get a gun and learn how to use it properly. Even the best police force can't watch out for you 24/7, they are much more likely to respond to an emergency than to be able to prevent one. Better to be able to defend yourself if necessary than end up a victim of domestic violence. Good luck to you.

You did the right thing by getting a report on file. Call the Check Sq at the police dept where you made the report and find out who is assigned to your case and talk with them.

Make sure you keep ALL documentation and make copies so you can give them to the detective to show all this guy has done. You may have to pay the companies to get copies of the paperwork he has signed so be prepared for that or you can ask the detective if they can get copies and give you copies of the paperwork for your files.

You might contact the three credit agencies and notify them what is going on and ask them if they can mark your file that no one give credit to anyone until they have talked with you first and see if they can help in that regard. Not sure if they do that or not so check with them and see. You can check the back of the credit card junk mail you get and get the information on the agencies and it may be on your credit card statements. I do know it's on the junk mail as an opt-out policy for receiving more junk mail.

USING ACCOUNT INFORMATION IS A CRIME--IT WAS NOT YOU USING IT.
ID THEFT IS REPORTED TO THE CREDIT CARD CO, BANK ETC WHERE THE CRIME TOOK PLACE.
MOST CREDIT CARDS CANCEL SERVICES AND ISSUE A NEW NUMBER FOR YOU WITH A DIFFERENT ACCOUNT.
BANK ACCOUNT CLOSE IT AND STOP ALL TRANSACTION WITH THAT ACCOUNT CLOSED, OPEN ANOTHER ONE IN YOUR NAME ONLY.
GET A RESTRAINING ORDER AGAINST HIM OR AN ORDER OF PROTECTION AGAINST HIM--TELL POLICE HE IS STALKING YOU AND HAS STOLEN YOUR ID AND CARDS ETC--THEY HAVE A CASE PENDING AGAINST AN INVESTIGATION BEING DONE. THEY MIGHT JUST DETAIN HIM FOR QUESTIONING.

If he shows up, call the Police to protect yourself. It's going to take a while to obtain a restraining order, or order of protection through the court. Don't hesitate to have him arrested if you are threatened.
