I need to take time off because my wife is about to give birth any day now, but I don't know if there is such a thing as paternity leave. Is it the same as maternity leave? and does my employer have to comply without placing me on his bad list? Is this possible in California? How do I go about it without risking losing my job? I may need 2-3 weeks to assist my wife during the recovery.

I'm in California too. You can have 6 weeks of paid time off when the baby comes, it's called Paid Family leave, and is part of the Family Medical Leave Act. Your employer needs to have at least 50 employees, and you need to have been there for at least 12 months to qualify. The pay comes from EDD, the same place your eife's disability will come from, and is about 55% of your gross paycheck. My husband took 6 weeks off using this. You need to meet with your HR department about this.

yes, yes, yes. One of the good things clinton did while in office. Family Leave Act. You can take up to 12 weeks off for family emergencies (births) with out a penalty. Only take what you need though. Talk to your boss asap and you may want to apologize that you've waited so long to approach him with this. Just blame yourself and say something like "I know that this is short notice, i'm very sorry for springing this on you but my wife is due to deliver any day now and when she does i'm going to need 2 weeks off. I wasn't aware of the family leave act until today or i would have come to you sooner. What can i do to help prepare for my absence and is there anything i could do from home to help fill in the gaps." Keep in mind they are not required to pay you just not to give you penalty. good luck!!!! -flowers

If you have been employed by your company for over a year and if they have over 50 employees then you are covered by the Family Medical Leave Act (FMLA). They don't have to pay you, but they do have to give you the time off and guarantee your job when you return to work.

Is there any way you can use your vacation time?

Ive heard that some upscale, family friendly companies are giving out paternity leave often. I would def talk to your boss about it.. my husband used personal days - and we were lucky enough to deliver on a Friday...

In Ca it would be "Family medical leave" this is used for just these occasions. Speak to your Human resource rep to file the proper forms. Congratulations on the baby!

Talk to you boss.... as many states do require that you also get time off for the birth of your child!! GOOD LUCK!
