The Guantanamo Bay prison is a place where those who would murder innocent men, women and children in the name of making a political point are taken to rot away. They are the ones, that for whatever reason, managed to not get killed on the battlefield. They are not American citizens. They are not members of a foreign army. They are terrorists.
The Gulags served as Russia's prison system for those who would dare question their socialist masters. Dissidents, free thinkers, capitalists, political rivals, political enemies.
If your question were even remotely based on reality, you, as a dissident, would be in Guantanamo. Not terrorists. And yet I doubt that you're hitting Yahoo! Answers up from Guantanamo Bay.
This is all rather simple logic. That's why it escapes you.

What we have are legal systems not justice systems. People rarely get true justice from any court.
Giving lawyers to terrorists is ridiculous, and it's sure not my idea of justice.
