His fathers never there and has denied my son! but he was there when he was born and signed the birth cert. Also I gave my son his name.(i know stupid me) SO I just want nothing to do with this man. He tries to get in contact with me sometimes and I can't hes not stable ANYWAYS Im getting married in about 1 year my B/F wants to adopt. So i asked bio father, he said he will relinquish b/c he dosent want to pay support. I just wrote the Child support and asked them to stop charging. MY POINT is WHAT SHOULD I DO? IS THERE AN AGENCY THAT WILL HELP ME? Until I'm married I'm conciderd a single mom and low income. WHAT DO I DO!

1. Your child's name makes ZERO difference in this discussion. What was put on the birth certificate only matters to the extent it is an admission of paternity.
2. While the father CAN give up his RIGHTS, that does NOT relieve him of his legal RESPONSIBILITIES, such as child support.
3. If your boyfriend adopts your son, the attorney handling the adoption WILL have the paperwork necessary for the father to allow the adoption. When the adoption is final, the father is no longer legally the father and know longer has rights OR responsibilities related to the child.

I would not do it until you are married. He needs to pay support for his son. If some thing bad happens to the father between the time you get married and your b/f adopts your son he will not be finical taken care of..
I understand what it is like to have a child's father not care of them and it is very hard.
My youngest sons father is like that he still owes me about a thousand Dollars and my son is now 19 so i will never see And i raised him all by my self as a single mom and low income.
you need all the help you can get so do not sell your self short yet

A lot depends on what state you live in. In most, a father cannot relinquish his parental rights. Also, in most states, child support obligations cannot be discharged or waived unless/until the child dies, reaches the age of 19, or graduates from high school, whichever comes first.

There should be a non-profit or public agency near you that can help you with your new husband's adoption of your son if, in fact, your state allows the natural father to relinquish his rights. Start with your state government website, county government website, and a web or phone book search of your local area for "adoption" or "parental rights."

There are attorneys out there who will work with you despite your economic situation.

Talk to an attorney.

This is yournew family's life. Take care of it for an hour of an attorney's time.

Probably, attorney will say bio dad can NOT relinquish his child support rights until new hubby adopts the kid.

And if biodad is nto the same as birthcertificate dad, then he probably owes child suport too, legally.

Methinks you are going to be taking your child for a paternity test soon....

You don't do anything until you are married and the adoption is in the works. Until you can support that child on your own you will depend on the father of that child to support him. AND if he chooses to not give up the rights, he will continue to be financially responsible for the kid. Don't make this mine and and every other tax payers problems because you aren't adult enough to handle your old boyfriend. .

By signing over his rights to his child in court and only a bad father would even consider doing that!
