If you are talking about the new law, it's to protect minors or persons under the age of 18 from second hand smoke which they have proven to be more deadly that actually smoking. As for the drinking behind the wheel, it is illegal and if they are caught drinking and driving in any state and are over the legal limit, they are going to jail whether there is a child in the car or not. I personal don't think the alcohol laws are stiff enough. I think that there should be no limit on the alcohol in a person's system. If they have any alcohol in their system they are charged with DWI and go to jail. It would save a lot of lives.

Are you out of your mind? California has some of the toughest drunk driving laws in the country. And driving with a minor in the car while intoxicated is an enhancement. What is it with smokers that makes them think it's OK to kill innocent people. And even if California's drunk driving laws were more leniant than smoking laws, why do you make the comparison? Alcohol in cars has been taken away for YEARS. This is not about car accidents. It's about second hand smoke that kills or injures people. This is an EXTREMELY uninformed post.

They are not taking cigarettes away – they are saying that subjecting a minor to second-hand smoke is going to be a criminal act, because it’s been scientifically proven that second-hand smoke is very harmful to children. If you want to continue smoking and get cancer, then I wish you all the best in that endeavor.
Driving a car while intoxicated is already illegal, and not only in California. To compare the ban on smoking in cars while children are present to alcohol as a whole is like comparing apples and giraffes. The comparison is nonsensical and invalid.

but the smoking can kill your child. Also-it's not legal to drink and drive in California. A .08 will get you a DUI, and anything under that will get you a wet reckless, or other charges.

ummm...there are already laws against consuming alcohol while driving and driving under the influence.
If you go out and drink and drive and kill someone you will be held legally responsible.
You can smoke in your car unless you have underage children. In my opinion it should be against the law to smoke in your house if you have children too, but that would be pretty hard to enforce.

The only thing about smoking I would say that if you have children in the car, it effects them too! Now, if your are by yourself or with another adult, that is different! Remember, you mentioned toddlers and smoking.. Not a good thing to suject your own children to is it?

That is my sentiment exactly. There are far more people who drink than smoke but the taxes don't seem to be rising on alcohol. Isn't alcoholism a disease? How many alcohol related crimes are there, I've yet to hear about a wife being battered because her husband had a cigarette.
Smokers are treated unjustly. I'm so tired of this state governing every aspect of our lives. In some places they want to make it illegal to smoke in your yard!

girl, its the same way here in kentucky....my mom used to smoke all the time in the car when i was a child..no laws then to stop her. i hated when she would have the windows rolled up while driving me to school. by the time i arrived at school, my clothes reaked of smoke. its not gonna stop parents from smoking in their houses around their children. in ky there's an age limit on that. i think the child has to be under 13. so if you over 13, then it doesnt matter if your parents smoke in the car...wtf!

Parents need to take responsibility for raising healthy kids, but do we really need a law? Smokers have become an easy target. The problem is they go so far overboard. Soon they will lose all credibility.

I live in cali and will say drinking IS NOT ALLOWED WHILE DRIVING ANYWHERE! Smoking is harmful not only to yourself, but to those exposed to second-hand smoke. To kill yourself this way is your choice, but give others the courtesy of smoke-free car rides.
