Keep your money. The buyer was informed that he could purchase insurance on the items. I hate to be that way, but I think they are just having buyers remorse because they spent the amount they did. It would be different if it was insured and the precautions in shipping weren't taken.

A tough question without a simple answer. If your brother is running this as a business he may care about his reputation (feedback score) enough to fix the issue. But, as others have stated above me - one negative wont' kill you.
As to the refund - it may be out of your brother’s hands. Should your buyer file a claim with PayPal for "goods not as promised" or "never received item" (He might not be above lying), he's going to win the refund. PayPal will side with the buyer 99% of the time because they want them to keep coming back to spend more money. Even if he doesn't win the PayPal claim - most credit card companies will let you charge back ANYTHING you buy online without batting an eye. Either way, you lose the $106 and the mugs.
Now...if he paid you with a money order or a check...he's pretty much screwed. Obviously, you've already cashed it so he really has no options but to talk tough or file a claim in small claims court. (People will threaten this but...most of the time they won't actually do it)
My advice - work out a deal with the buyer. Most angry eBay buyers are good people at heart, they just feel like they are being "scammed" by a faceless seller who is hundreds of miles away so they come out swinging... Try to come to an agreement that you both can live with and move on – it’s not personal, its just business.

Keep the money...that what insurance is for. If it was stated or outlined in your auction page making it an option to the buyer and he failed to purchase insurance that was optional, then the blame falls on him, NOT your brother. Tell the buyer to take up his complaint with the P.O. and try to receive a refund from them. Buyer deserves no part of that money whatsoever!!! whether he is pleased with purchase or not! Your mom did her best to ensure that parcel had been securely packaged-that's the most you guys can do. Don't feel intimidated or threatned by that clown..What's the worst he can do by the way...Best thing-inform Ebay of this transaction gone bad situation, because for you know there doesn't have to be anything the matter with the mugs!

I always offer insurance as an option and state that without the purchase of it, I am not responsible for damaged items. That will cover you.

keep the money, if his feedback is mostly good, then one bad one can't be too damaging to his record. Plus if the man didnt take out insurance its his own fault.
