IN AUGUST OF THIS YEAR MY EX WAS ORDERED TO PAY CHILD SUPPORT..IT'S OCTOBER NOW AND STILL NO MONEY...I KNOW HE IS WORKING AND HE SAIS THAT THE MONEY WILL BE DEDUCTED FROM HIS PAY CHECK AUTOMATICALY...ANYBODY KNOWS HOW THIS THINGS WORK ?

Don't take his word for it. You need to go back to your attorney, or the division of child support (which-ever method you used) and file the paperwork you need to have his wages garnished- some states won't do this unless he is behind several months, or if it's over a certain dollar amount (I think I was told 3 months, and/or a few thousand dollars). They're not always helpful, but you're just going to have to stay on them. I went 15 months as a single mom before they were able to track down and start garnishing his wages- as soon as they found him, it was only 2 months till I got my 1st check, and I've been getting checks regularly, ever since. (Also, as income tax season approaches, have them red-flag his account and the IRS will garnish any money he has coming to him on his taxes.) Good luck and try to be patient- this may be a long, bumpy road...

I was fortunate in that the courts didn't need to garnish my ex-husband's wages. He was always on time (maybe he was late once, but I had forgotten too)

Is there a way you can work with the children's father in the meantime? I know that you probably shelled out alot in school clothes and school supplies. Is there any way you can ask your children's father if he can help with those expenditures, which are really above and beyond what child support is supposed to cover.

I've learned that demands don't work, but sometimes VERY subtle guilt trips do....

You'll have to check how things work in your state. In IA once it is court ordered it is deducted from your paycheck, no options otherwise. If there are problems then you get child support recovery unit involved. They'll charge you $25 to get the process started and recently they added a yearly $25 fee.

Check with your local agency and if you have the number to his office to find out that support is being taken out. If his company is not doing anything about it they can get in serious trouble behind that for non compliance of a court order. If he's paying you out of his own pocket and your not getting any money the court will suspend his drivers license, place a freeze on his bank account and if he gets a tax return they can claim that for you.

"IF" the court ordered him to pay through the courts.. in my expirence he has to be 3 months behind in child support before they will attach his paycheck unless it was already agreed upon to do it this way.. if i was you.. id call the court house or child support enforcement, who ever is the "middle man" and find out how long it takes.. ALSO usually it takes 6 weeks of processing the first payment once its sent to get the account set up before it starts coming like clock work.. So i would call the "middle man" and find out whats going on. Now if he wasnt ordered by the courts to pay through the courts, then its his responsibility to send u the money and theres no middle man at all so he'd have to be the one that is directly paying you..and he could be lying.. Now if he has a job that can take out an allotment from his check to directly pay you that usually only takes approx 30 days to get going.. But the judge will tell him that its his responsibility to make sure u get paid , not yours.. and if the money hasnt been deducted from his check already and he was ordered to start paying c/s as of the first of September.. then he's already behind in his child support..

Id definately call the courts and find out whats going on if it was ordered by the courts , IF IT WASNT ordered that he pay through the courts, get in contact with ur local child support enforcement agency and get it set up through them, that way they will see to it that he pays one way or another, and if he gets behind.. or doesnt pay, they will take it out of any tax refund he gets, or suspend his license, or put liens on any property he owns until he is caught up.. and that keeps u from worrying about having to come up with more money to keep taking him back to court every time he decides he doesnt want to pay..

Check with the Child Support Collection Unit in your state or county. It's usually in the same building as the courthouse or near it. Support is better collected from them because if the paying person stops paying, THEY will help you take legal action.

It can take quite a few weeks or so before you receive the check. Also the court will probably take their share of court costs and filing fees and whatnot. The court likes to get theirs first. Give it alittle more time.
If he ever gets behind on his payments, then when he does his taxes you will get child support from his state taxes.

Yes, the court sends paperwork for his employer to fill out, and once that is done, and processed, the support will be deducted.

If you have questions, call the child support bureau. You probably have a caseworker there, so it might be a good idea to find out who that is anyway? Take care and i hope it works out.

The way mine was set up was through the courts and I got a check the week after it was ordered then when he quit paying that way they garnished his wages and it took 2 weeks for me to get the first check.

I don't know how it works in your state, but once our child support was established, it took about three months before I saw any money from the AG's office.
