I think that smoking/cell phone bans make a lot more sense than seatbelt laws. The debate here is about individual rights. As my high school civcs teacher used to say, your right to swing your fist ends at my nose. In other words, you are free to move your arms any way you want unless doing so causes harm to someone else. That's a pretty simple example, but it illustrates very clearly the principle of personal rights upon which our country was founded. The government's main job is to protect its citizen, not only from foreign invasion, but also from other citizens. The smoking ban seeks to do just that. By disallowing certain distractions, they hope to protect everyone on the road. Seat belt laws, on the other hand, are meant to protect individuals from themselves. This, in my opinion, is government overstepping its bounds. They have a word for governments that seek to protect their citizens from themselves: communist.

That's an interesting question. I don't smoke OR drive, but when I'm in the family car I feel as if I'm in an extension of my home in some ways.
I'm sorry for the newly quit who have to drive in stressful situations.
If they want to protect the children, they should limit the law to drivers who have kids in the car, and not extend it to everyone. That's overreaching. Politicians use "the children" as pawns to get everything and anything passed. It's so cynical.

And Ryan, I totally agree with you about cell phones.

Though I smoke a lot, I fully support the ban on smoking while driving.For safety of myself and others,both of my hands must be on the steering wheel and full attention on the road.We should not oppose for the simple reason that it is imposed by some authority.

what I saw in the paper was that it was a ban on smoking in the car if there were children passengers. To protect the kids. That's a good thing.

i think thats not the answers...its even better to ban using of cell phones than to ban smoking while driving, i just think its stupid

Another freedom down the drain. I don't smoke but thats not the point. Heck in my state we don't enforce motorcycle helmets or seat belts. Glad I don't live in CA.

god what nex am i only going to be aloud to smoke in the closet of my bedroom with the lights out next. i smoke because i want to and its my damn car . thats retarded(no offence) im sorry liberals can say all they want that they want to protect or rights but yet its them who are takin most of them away. who got the parental warning on music.......... tipper gore what is she a liberal democrate

I came into this sect just to rant on this very subject!!! UGH!!!

Yes, I am fully aware that smoking cigarettes has ill-effects on human health (so are a million other experiences available on this planet!)...however, spraying Lysol/Clorox/air fresheners all over your home is even more immediately toxic...and as far as the "second-hand" propaganda...the toxins of the latter are linked to more developmental disabilities, as well as SIDS...but you can buy & use these without the government even adding those possible "side effects" to their ads or the products...go figure!!!

I would looove to see such diligence of freedom limitation aimed at the corporate world of toxic waste dumping, & I'd looove to see action by the FDA & AMA in regards to the poisons in our foods & their sources...these are worthy tax expenditures!!! Telling the public that their vehicle is now imminent domain to governmental ruling is not only absurd, it again reflects the stupidity of those wonders in office today. It still makes no sense that motorcyclists can have the freedom of helmet/no helmet, yet if we are not fully strapped to a much more secure machine with safety opts we dearly pay for, we are ticketed unmercifully, and school busses are not included in that "safety ruling" still, even with the many videos of children thrown like rag dolls during even minor accidents.

Alcohol ads are now back on t.v. (drunk drivers kill more kids than smoking does), along with thousands of prescription drug commercials for ailments that are caused by the ingredients in our foods, hygiene, & home cleaning products...AND THIS IS OKAY!!!??? And We the People don't SEEE the controversy & stupidity being unloaded on us to distract from the truly important issues & knowledge???

My car is mine...just like my home...I say what goes on in it, not my tax dollars, nor the governing idiots at large. They haven't even done a great job with cell-phone use in moving vehicles, let alone adding one more thing police can pull you over for for ridiculous quota needs, when they could be doing something more respectable & in line with their job...protecting citizens from true dangers.

We pay for the vehicle, we pay for the maintenance, horrendous fueling options (way old technology in this computer era, yes?), & paperworks to drive it, we pay for the roads & their upkeep, & we pay for the police, EMTs, fire dept., & mtce. crews for their involvement on those roads...now we're paying for laws that put our freedom within that vehicle in total jeopardy??? My $$$ would better be spent on a gazillion other needs for this country than focusing on the continuance of our governments gone awry, & the People's ignorance to everything else in it's wake.

Our America is going to shameless ends, how are we to reflect a light of this world, a true conglomeration of everything of & on this planet, when we allow such stupidity to reign us??? And California...you truly need to drop off into the ocean for allowing this garbage to start in the first place...get rid of your corporate smog, then maybe you'd be better faced with inner car pollution!
