I just got unemployed, I am bearely sustaining myself rightnow, but currently working for a job,. but I have a court order saying that I have to pay 1500 a month., what should I do to get it deducted? where am i going to get money from to pay the child support when i bearly have to eat. when i find a job, my job wont be paying me as much as i was making before, and wont be able to afford such a big amount of child support. what should i do?

I never understand why this is thought to be so complicated. You were given instructions as to what to do if you lost your job or were unable to work.

You follow those instructions. You will have to request a court date during which you explain your situation and the judge will bring the payments in line with your lack of income. When you find a new job, you either start payments again or request a court date to set the new amount of child support due.

The non-payment of support is no reason for you to violate the court's order of visitation. It is true that you might think that you can retailliate by withholding the child from his father, but that would be a violation of the custody order the same as withholding support is a violation of the support order. You should have the court ATTACH his wages so that they will be taken from his paycheck automatically and then sent to the court and then the court will pay it to you. That way you'll have a record of his timely payments. If his employer refuses to obey the attachment order then the employer is subject to arrest and jail time, as well as a large fine. The attachment is a Federal law that the states can implement. The support is for the benefit of the child not for the benefit of you. You will have to go into court and file a petition for enforcement of the court's order of support and ask for his wages to be attached. You should also have the order set up so that he will pay on the current support order as well as some amount on the arrears .. so that he'll pay on the past due amount while he's paying on the current amount.

First, ignore these morons telling you to live up to your responsibilities and get a better job. You can't pay what you don't have and the job market is horrible, at least where I live.
Second, get your court order and proof of current income and go to your local county child support office,TODAY!!!!!!!!!!! They can arrange a temporary reduction, while you are unemployed and re-figure the amount of support based on your new earnings.
I'm in the same situation, and working with the child support office is the only thing keeping me out of jail.

Just go to the judge and be honest. Bring in a pay stub, some bills that you have to pay, etc, and show him what you have left over. Try and make a deal with him. but don;t try to bargain too much. Say after everything is said and done, you only have 200, ask if you can pay 100 for child support. Tell him you are trying to find employmrent, and be sioncere about it.

Go to court and file for a reduction in support. Support can also come from unemployment income. But if you don't go to court and get it lowered you will eventually be held responsible for the entire amount you didn't pay. Since cs is based on your income, there shouldn't be a problem in getting it lowered. When you get another job, then you'll have to go back and have it adjusted again.

You can request a hold on current support payments. Do it ASAP because the longer you wait the worse it gets. You will still owe that money but they won't fry you for not paying it right now. Also file for a review of the current support. They will lower the ordered support to be in line with you new wage.

You can try to ask the child support agency for a modification or if they refuse or deny your request you can attempt to file the modification paperwork yourself. Typically you will still be required to pay your court ordered child support even if you are unemployed. It will be arrears and once you get another job they will be taking out child support, arrears and interest...so your bill will go up.

You need to have your attorney take you back to court with necessary financial documentation to ask for an adjustment of your child support. Don't ignore this as non-payment can land you in jail and then you will forever be behind the eight ball.

Back back to the courts and judge that ordered your child support, and advise him/her of your job loss, the will set a court date for a new hearing to adjust your child support to your new earning wages.

If you dont do this and not pay your support you will go to jail.

The responsible thing is to contact whoever handles this where you are from and explain your circumstances, do the financial statements and pay whatever you can in the interim while you find a job.

It piles up and it piles up quickly so keep on top of it.
