It's actually not a completely silly question, even if it's meant that way. It goes to the heart of responsibility, and the theory that surrounds it.

1. If the baby is a full human life, he is responsible for his actions.
2. If the baby actually CAUSED the death, then there is some basis for the argument.
But...
3. You'd have to prove intent, which is clearly impossible. Thus, the worst charge you could bring would be something like involuntary manslaughter. And, even then, I think you'd have some issues with accountability. Juvenile defendents are treated differently of course, and i can't imagine any juvenile court charging someone for an accidental "crime" when clearly they had no understanding of the seriousness.

4. The baby would have had to have some ability to prevent the death. I think, in most cases at least, this isn't true.

So, basically, no.

Not necessarily. It could be ruled self-defense if the woman was planning to have a partial-birth abortion.
