The baby isn't a baby until it is born. Once it is born, it should be removed from the mother's care and given to someone on the outside.

How would you avoid it? Make the woman have pre-term labor? That is more unfair as it would put the baby at risk.

Once the baby is born, he or she should not remain in jail, but go to the next of kin to take custody of him or her.

If the woman goes to jail, the unborn child goes with her. Since an unborn child is not really a legal entity, that's the only way it can go to jail.

It depends if the attack was in self defence. If not, the woman should be under house arrest and be on probation. I don't think its safe or right for a pregnant woman to be in jail or right for a newborn to be in there.

Give pregnant criminals a free pass?not happening.Current system is that pregnant convicted felon goes to special unit in pen.After birth of the child,if no family members step up to care for baby,state steps in and cares for it through states foster care program.
FYI: just because a woman gives birth,doesn't make her a "mother".Same goes for a male sperm donor;making the donation doesn't make him a "father".It's a blessing to the children to take them away from their felonious mothers.
