He should and he would. That type of situation is already covered by legislation in most Western countries. After a few weeks of pregnancy (it varies from country to country) the fetus has legal status. And even if it is within the legal boundaries for a voluntary abortion, the offender would still be prosecuted, because he caused the abortion, it wasn't an option of the mother.

Thats a hard question!! Depends on the senario I guess.
If the women never told whom was beating her that she was actually pregnent and there was no visable signs that she was even pregnent, then no.
If the women was showing and she did tell whom ever that she was pregnent, then the person who got a attcked should go to jail.

That depends on what you mean by "attack"

If you mean hit her or any other type of physical contact then yes. That person should go to jail.

If the attack is verbal then no.

The assailant should go to jail for attacking the woman, but he/she shouldn't be charged with murder just because the fetus died. It doesn't make sense to keep abortion legal if someone other than the mother can be charged with murder if he/she is responsible for the death of the fetus.

uh..yes. I know where you are getting at. You need to look at the laws, the laws say if the child was BREATHING then that is murder. But if the child is still a fetus, mostly like the person who attacks the pregnant woman and her fetus dies, they will get off. Look up that law.

If I'm a lefty, I'd argue that the attacker should send the woman a bill as a fee for service.

Some states allow for it and some states don't. I do believe that it should definitely happen for third trimester incidents.

As for how does this relate to abortion (as this is usually the set up)--abortion isn't performed through random assault.
